SALES TAX NEWS

1️⃣ The Louisiana Department of Revenue (DoR) announced it will no longer print and mail copies of state sales tax returns to businesses registered to collect and remit Louisiana sales tax.

2️⃣ In Indiana, the Department of Revenue determined that an out-of-state video game publisher is not required to collect sales tax on three optional purchases: a monthly subscription for online multiplayer access, in-game items, and virtual currency. These items did not qualify as taxable physical goods or digital products.

3️⃣ The Texas Comptroller issued a private letter ruling that clarifies the taxability of hosting and repair services for cryptocurrency mining machines. The ruling determined that the repair and replacement services for the customer’s machines are taxable as they involve the maintenance of tangible personal property.

4️⃣ California has extended the January 31, 2025, sales and use tax filing deadline to April 30, 2025, for taxpayers affected by recent wildfires, including those in Los Angeles and Ventura counties who owed less than one million dollars on third-quarter 2024 returns.

5️⃣ A plan to eliminate Missouri’s income tax is headed to the state Senate for debate. If the amendment passes, individual income tax would be eliminated in 2027, making the state solely reliant on sales tax for revenue.

6️⃣ The Connecticut Housing Committee voted Thursday to advance a bill imposing a 3% sales tax on construction materials. Developers can avoid the tax by setting aside one in five units as affordable or building at least 50 affordable units overall.

Q (Ben): Is a resale certificate the same as an exemption certificate?

A: A resale certificate is also called a sales tax certificate, reseller permit, or sales tax exemption certificate. If you qualify for a resale certificate, you do not have to pay sales tax when you purchase qualifying goods from a vendor. However, you are still responsible for collecting sales tax from customers.
